View Full Version : Lawsuit filed in Disney monorail pilot's death dismissed

LAKE BUENA VISTA --

The wrongful death lawsuit filed by the family of a monorail pilot who died in a crash two years ago at Walt Disney World has been dismissed.

Lawyers for both sides said the lawsuit has been settled, but they're not giving out any other details.

Austin Wuennenberg, 21, was killed July 5, 2009 when two monorails collided at the Transportation and Ticket Center as guests were leaving the park following a Fourth of July fireworks show.

The other monorail pilot was backing up, but said he believed he was backing up on a separate line.

National Transportation Safety Board documents show the other pilot never saw Wuennenberg.

Wuennenberg's mother filed suit against Walt Disney Parks and Resorts early last year. She accused her son's supervisor of leaving his post, creating a dangerous situation.

The Occupational Safety and Health Administration (OSHA) fined Walt Disney $44,000 in penalties for the crash.

The NTSB investigation is ongoing.
